Our NDA Agreement

“Confidential Information” in this Agreement means all information and ideas in whatever form, tangible or intangible, whether disclosed to you in written, oral, encoded, graphic, magnetic, electronic or any other tangible or intangible form, and whether or not labeled as confidential by AR30 LLC or its owners, managers, employees, agents or representatives (“AR30 LLC”) or otherwise provided by AR30 LLC. “Confidential Information” includes, without limitation, the following: (a) program information, schematics, techniques, strategies, development tools and processes; (b) Workout routines; meal plans, grocery lists, fitness challenges, coaching methodology; (b) information about costs, profits, products and sales; (c) plans for future development and new product concepts; and (d) all documents, books, papers, drawings, models, sketches, digital media, and other data of any kind and description, including electronic data recorded or retrieved by any means, that have been or will be given to the you by AR30 LLC, as well as written or verbal instructions or comments.

As a participant in the AR30 Challenge, you will be receiving Confidential Information owned by AR30 LLC and shall hold all Confidential Information in strict confidence and shall not disclose any Confidential Information to any third party. You shall take all reasonable measures to protect the confidentiality, and avoid the unauthorized use, disclosure, publication, or dissemination of the Confidential Information; and you will not interfere with any business of AR30 LLC through the use of any Confidential Information acquired hereunder nor use any of the Confidential Information for commercial gain. You acknowledge that AR30 LLC is neither responsible nor liable for any business decisions made by you in reliance upon any Confidential Information disclosed hereto.

For a period of five (5) years following your acceptance of this Agreement, you will not: (a) engage, directly or indirectly, in the same or similar activities as AR30 LLC; (b) take any actions to indirectly or directly gain commercial benefits through use of the Confidential Information; or (c) circumvent AR30 LLC by contracting directly with any contacts or 3rd parties which AR30 LLC has identified as having access to the Confidential Information, or that you have been connected to as a part of your relationship with Ar30 LLC.

You agree that any unauthorized disclosure or use of the Confidential Information will cause irreparable harm and significant injury to AR30 LLC of an amount that may be difficult to estimate. As such, you agree that AR30 LLC will have the right to apply to any court of competent jurisdiction for injunctive relief as well as any other remedies available in law and equity, and if AR30 LLC prevails, AR30 LLC will be entitled to recover court costs and reasonable attorney’s fees. This Agreement shall be governed by the laws of New York without giving effect to conflicts of law provisions hereof.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us.
